Short-Term Vacation Rental (STVR) Regulations

In Potsdam, there are regulations for short-term rentals and other usage of residential spaces, which can affect you as a Host. Renting out your own home or a vacation home may be restricted and subject to conditions and time limits. A bylaw prohibiting the misuse of residential space came into force in April 2021.

Housing

Under Potsdam's regulations, any space that is actually and legally suitable for permanent residential use is classified as living space. Residential spaces can be apartments or individual living rooms. Premises that have been constructed for purposes other than residential use and are used accordingly are excluded from the regulations.

Permitted short-term rental

According to the current housing rules in Potsdam, a residential space can still be used for non-residential purposes if rented out for less than 50% of the residential space. Thus no permit is required for renting out individual rooms if they cover less than 50 percent of the living space. Sharing your home up to 8 weeks in a calendar year is allowed.

Permits

Short-term rentals beyond the above-described exemptions require a permit. The permit is issued by the state capital Potsdam.

A permit can be granted if overriding public interests or private interests worthy of protection outweigh the interest in preserving the living space.

A permit may be granted if the interest in preserving the housing is taken into account by compensatory measures in a reliable and appropriate manner. This may be done by providing replacement housing or by making a compensatory payment. Approval may be granted for a limited time and with conditions.
